In February of this year, Assemblymember Randy Voepel, a Republican from Santee, California, introduced AB 2483, a bill that proposes to require the State of California to indemnify members of its occupational licensing boards for antitrust damages if the alleged conduct took place in their “official” capacity as board members. It also proposes to declare that treble damage awards are not considered “punitive,” thus complying with the state’s indemnification laws.

Consumers of legal services seeking a quick way to find lawyers while guarding against the prospect of runaway hourly billing will now have to look a little harder. Avvo has stopped offering its popular Avvo Legal Services. The service is no longer offered on its website, and the general counsel for Internet Brands, which recently acquired Avvo, has indicated that the service will be discontinued by the end of this month. Tom has already posted about the NJ Supreme Court's summary rejection of Responsive Law's challenge to that state's latest ethics opinion impacting Avvo Legal Services. But as Avvo's former Chief Legal Officer, I wanted to offer a few of my thoughts on the Court's lazy, arrogant, and retrograde decision. Sorry—I may be frontrunning my conclusion here. The New Jersey Supreme Court has declined to review a bar ethics opinion prohibiting lawyers from participating in fixed fee legal services platforms such as Avvo Advisor. The court’s inaction will most immediately impact consumers of legal services in New Jersey, but ultimately could expose members of the New Jersey bar ethics committees to antitrust liability. Almost every driver has gotten a traffic ticket at some point. And almost every one of those drivers would have liked to have exercised their right to fight the ticket in court. Most decide not to, though, because of the expense of hiring a lawyer or taking time off to appear in court themselves. |
