The resignation of Judge Richard A. Posner of the United States Court of Appeals for the Seventh Circuit is the result of an acute revelation about the way self-represented litigants are treated in this country. Judge Posner, one of the country's most distinguished appellate judges, explains that he decided to resign his position after realizing how the legal system mistreats people who represent themselves in civil cases. Posner described this revelation as an awakening "from a slumber of 35 years."

Responsive Law testified this week at a District of Columbia Council hearing regarding a proposed bill to expand funds for legal service providers representing low-income DC tenants in housing matters. Responsive Law supports the bill's spirit and objectives, but we expressed concerns that the limits imposed in the bill's text will stifle innovation in the provision of types of legal services available to the public. The State Bar of California has established the Governance in the Public Interest Task Force to help improve the public protection function of the State Bar. California law holds the protection of the public as the State Bar’s highest priority. Responsive Law believes that unchecked self-governance by lawyers is not in the interest of the public, and issued comments offering guidelines that would better protect the public. Responsive Law has just released its Report Card on Barriers to Affordable Legal Help. The report card grades all 50 states and the District of Columbia on how their regulations regarding the practice of law restrict consumer access to the legal system. The World Justice Project has released its 2015 Rule of Law Index, a comprehensive ranking of countries based on how their public experiences the rule of law. We've reported on the Rule of Law Index before, and sadly the story remains the same for the United States. While we rank among the world's leaders in most areas, we continue to bring up the rear among our peers in accessibility and affordability of civil justice. |
